Data Protection Notice for Customers

This Data Protection Notice (“Notice”) outlines the basis on which The MakersPlace Ltd (“we,” “us,” or “our”) may collect, use, disclose, or otherwise process the personal data of our customers in accordance with the Personal Data Protection Act (“PDPA”). This Notice applies to personal data in our possession or under our control, including data handled by organizations we have engaged for collection, use, disclosure, or processing on our behalf.

      (a) has contacted us through any means to inquire about our goods or services, or
      (b) has entered or may enter into a contract with us for the supply of goods or services.
    • Personal Data: Information, whether true or not, about a customer who can be identified:
      (a) directly from that information, or
      (b) indirectly, when combined with other data to which we have or are likely to have access.
  2. Depending on the nature of your interaction with us, personal data we may collect includes, but is not limited to:
    • Name
    • Residential address
    • Email address
    • Telephone number
    • Gender
    • Date of birth
  3. Terms not specifically defined in this Notice shall have the meanings ascribed to them under the PDPA, where applicable.

  1. Conditions for Collection:
    We generally collect personal data only if:
    • (a) You (or your authorized representative) voluntarily provide it, after being notified of the purposes for its collection and usage and consenting to these purposes, or
    • (b) Collection without consent is permitted or required by the PDPA or other applicable laws.
  2. We will seek your consent before collecting additional data or using your data for purposes not previously notified (unless otherwise permitted by law).
  3. Purposes for Use and Disclosure:
    Your personal data may be collected, used, and/or disclosed for purposes including, but not limited to:
    • Fulfilling obligations related to goods and services requested by you.
    • Verifying your identity.
    • Responding to inquiries, applications, complaints, and feedback.
    • Managing our relationship with you.
    • Processing payments or credit transactions.
    • Using photographs and video recordings on our website, social media, third-party platforms, and marketing materials.
    • Any additional purposes for which you have provided data.
    • Other related business purposes incidental to the above.
  4. Disclosure of Data:
    We may disclose personal data where necessary to fulfill our obligations to you.
  5. Retention Beyond Relationship Termination:

  2. We may require reasonable time to process your request and notify you of the consequences, including any legal implications or effects on our ability to provide goods or services. Generally, requests are processed within three (3) business days.
  3. Depending on the scope of your request, we may not be able to continue providing goods or services. Should you wish to cancel your withdrawal, please inform us in writing.
  4. Withdrawing consent does not affect our right to collect, use, or disclose personal data without consent where permitted by law.

 

Access and Correction

  1. To access or correct your personal data, submit a written request to our Data Protection Officer.
  2. A reasonable fee may apply for access requests. You will be informed of the fee before processing begins.
  3. We will respond to requests as soon as reasonably possible, generally within three (3) business days, or inform you if more time is needed. If a request cannot be fulfilled, we will provide reasons, unless exempted by law.

  1. We take appropriate administrative, physical, and technical measures (e.g., encryption, restricted access) to safeguard your personal data against unauthorized access, disclosure, or other risks.
  2. While we strive to ensure security, no method of transmission or storage is entirely secure. We continuously review and enhance our security measures.

Retention of Personal Data

  1. We retain personal data as long as necessary to fulfill its purpose or as required by law.
